Ringkasan Kegiatan

The process of delineating a straight maritime baseline of a given country that has a coastline is governed by the six paragraphs that make up the 7th article of The United Nations Convention on The Law of the Sea (UNCLOS) III, 1982. Indonesia, as an archipelagic sovereign state that ratifies the UNCLOS has not fully implemented the concept of a straight baseline, particularly in the paragraphs 3 and 5 of UNCLOS Article 7. The 3rd paragraph contains states that a straight baseline must be in conformity with the general direction of the coastline. Meanwhile, the 5th paragraph states that a straight baseline may be implemented to extend the territorial waters of a sovereign state if it is historically proven to be a site of economic significance and importance to the local community that resides within the area.This research studies the implementation of a straight baseline that complies to the regulations set by the UNCLOS Article 7 in the Northern Coast of Sulawesi Island. Firstly, the currently existing normal baseline is modelled using a 2nd degree polynomial equation. Secondly, linearization is carried out to obtain the slope gradient of the linear equation that has been derived from the modelled baseline equation. This gradient is then considered to be the reference value to generate a general trend of the coastline’s direction. As a form of control, the azimuth that is formed by the proposed straight baseline should not differ significantly from the value of the gradient. Furthermore, literature studies related to activities of the local community from the Northern Coast of Sulawesi is also carried out to further justify the proposed extension of territorial waters that are compliant to the 5th paragraph of UNCLOS Article 7.The results of the proposed implementation of UNCLOS III Article 7 that is discussed in this study yields a significant increase in the area of inland waters of 17,363 km2. This extension of Indonesian inland waters is expected to enhance security, peace, and political stability within the area and reduce illegal fishing practices by foreign fishermen by exercising the right of full sovereignty.
